Advice from Lawgistics: Pandemic impact on annual leave entitlement

The change in March 2020 allowed for four weeks of annual leave to be carried over. So, as a reminder, any carried over leave must be used in 2022!

In previous legal updates, Lawgistics have advised about the slight relaxation regarding annual leave due to COVID-19.

As a recap, in March 2020, workers were allowed to rollover their annual leave if they had been affected by COVID-19 and unable to utilise their statutory annual leave. This was to encourage staff to work together in the national effort again coronavirus.

Workers have been allowed to carry over their 2020 and 2021 annual leave entitlement into this year.

Usually, most entitlement cannot be carried over (please note, this does not apply to ALL scenarios, for example, the exceptions are sickness and maternity leave).

As an employer, you have an obligation to ensure workers are given adequate opportunity to use their annual leave and this cannot be paid in lieu (annual leave can only be paid in lieu upon a worker leaving the employment).
